SPECIAL USE PERMIT PROCESS

The Franklinton Board of Adjustment will hear this request and make findings based on the evidence and testimony received at the Evidentiary Hearing or otherwise appearing in the record of the case.

 

Submittal Process

 

•Submit this application to the Zoning Administrator.

• A filing fee of $_____ shall be paid to the Town of Franklinton upon submittal of this application.

• The questions included in the Statement of Justification below are to be answered in full by the

applicant in order for the application to be deemed complete, and shall explain how the proposed

special use will meet the general Approval Criteria of Section 2.4.16 of the Town of Franklinton Unified

Development Ordinance.

• An application for a special use permit shall include a site plan (prepared in accordance with

Section 2.4.14, Site Plan, Major) depicting the proposed use and site configuration.

• The site plan shall be approved prior to a decision on the special use permit application by the

Board of Adjustment. In the event the special use permit approval requires amendment to the

site plan, the amendment shall be processed in accordance with Section 2.4.14G, Amendment.

• The applicant may submit any other documentation or exhibits (such as a subdivision plat, survey map, etc.) which the applicant feels the Board of Adjustment will need in order to render a decision based on all necessary and pertinent information.

• When deciding applications for Special Uses, the Board of Adjustment must follow quasi-judicial procedures. This means that, among other things, the Council must conduct a hearing to gather evidence in order to establish sufficient facts to apply the ordinance. Also, the applicant shall not engage in ex parte communication with members of the Board of Adjustment. The applicant must appear in person at the hearing to give evidence.  If the applicant is a corporation, it must be represented by an attorney.

•  Anyone wishing to speak at the evidentiary hearing must be sworn in by the Town Clerk prior to presenting evidence.
